FOUNDATIONS OF moon Law

The United Nations’ Outer Space Treaty is the foundational law regarding all Earthly activities pertaining to the Moon.

Article I of the Outer Space Treaty, in particular, states that the exploration of “outer space, including the Moon and other celestial bodies shall be carried out for the benefit and in the interest of all countries” (emphasis added).

This article of the Outer Space Treaty emphasizes an egalitarian approach to space exploration, holding that there shall be free access to celestial bodies such as the Moon, and that space and Moon exploration shall be the “province of all mankind.” 

Article II is also relevant in this respect in that it prevents nations from claiming sovereignty over the Moon or other celestial bodies through use, occupation, or any other means.

These articles still serve as the legal basis for activities carried out with respect to the Moon, though the 1984 Moon Agreement served as an attempted update, ultimately delivering mixed results.
